Comparative Negligence: NY vs. IL

New York: Pure Comparative

You can recover damages even if 99% at fault. Your recovery is reduced by your percentage of fault. No complete bar to recovery.

Illinois: Modified Comparative (50% Bar)

You can only recover if 50% or less at fault. If more than 50% at fault, you recover nothing. (735 ILCS 5/2-1116)
